These terms govern your use of the Subby mobile application — published on the App Store and Google Play as Get Subby — and the Subby website. By creating an account or using Subby you agree to them. If you do not agree, do not use the service.
Subby is operated by Lets Have Coffee (PTY) LTD ([registration number]), a company registered in South Africa. "We", "us", "Subby" and "Get Subby" mean that company and its app. "You" means the person or business using the service.
You must be at least 18 years old and able to enter into a contract. You must give accurate information when you register and keep it up to date.
You are responsible for everything done under your account and for keeping your login details confidential. Tell us immediately at support@getsubby.co.za if you think your account has been compromised.
Subby is a directory and a set of project management tools. We provide the platform on which users list their services, request quotes and record their own project information.
We are not a party to any agreement between a homeowner, builder, subcontractor or supplier. We do not perform building work, supply materials, or act as an agent, broker, employer or contractor for any user. Any contract for work or materials is between those users alone.
We do not vet, verify, endorse or guarantee any user, listing, qualification, registration, licence, insurance, price, quotation or standard of work. Verifying a subcontractor — including their NHBRC registration, CIDB grading, tax status, insurance and references — is your responsibility before you appoint them.
Budgets, cost tracking, quantity take-offs, rates and any estimate the app produces are indicative planning aids based on the information and assumptions you supply. They are not a professional quantity surveying, engineering or architectural service, and they are not a substitute for a priced bill of quantities from a qualified professional. You must verify every figure before you rely on it commercially. We are not liable for decisions made on the strength of these outputs.
You keep ownership of the listings, project records, photographs, drawings and documents you upload. You grant us a non-exclusive, royalty-free licence to host, store, reproduce and display that content for the purpose of operating the service for you and the people you share it with.
You confirm that you have the right to upload the content, that it does not infringe anyone's rights, and that where it contains another person's personal information you are entitled to share it.
You may not use Subby to post false, misleading or fraudulent listings; to impersonate anyone; to harass, defame or threaten another user; to upload unlawful, infringing or malicious content; to scrape, copy or resell directory data; to send unsolicited marketing to other users; to circumvent access controls or subscription limits; or to interfere with the operation or security of the service.
If you publish a listing you are responsible for its accuracy and for keeping it current. Listing information is publicly visible in the app.
If you submit a quote, the price, scope, validity period and terms are yours and bind you, not us. If you request quotes, we do not guarantee that you will receive any response, or that the responses will be accurate or competitive.
Some features require a paid subscription. Prices are shown in the app in South African Rand and include VAT where applicable. Subscriptions bought through the Apple App Store or Google Play are billed by that store and renew automatically until you cancel in your store account settings.
Cancellation stops the next renewal; it does not refund the current period. Refunds for store purchases are handled under Apple's and Google's refund policies. We may change prices with at least 30 days' notice before the change affects your renewal.
We aim to keep Subby available and working, but we provide it on an "as is" basis. We may change, suspend or discontinue features, and we may carry out maintenance that interrupts access. Keep your own copies of anything you cannot afford to lose.
You may stop using Subby and delete your account at any time. We may suspend or terminate your account if you breach these terms, if your use exposes us or other users to risk or legal liability, or if we are required to do so by law. Where it is reasonable to do so we will give you notice first.
To the fullest extent the law allows, we are not liable for any indirect, incidental or consequential loss, or for loss of profit, revenue, contracts, data or goodwill, arising from your use of Subby, from your dealings with another user, or from any building work performed or not performed.
Where we are found liable, our total liability is limited to the greater of the subscription fees you paid us in the twelve months before the claim, or R1 000. Nothing in these terms limits liability that cannot lawfully be limited, including your rights under the Consumer Protection Act 68 of 2008.
You indemnify us against claims, losses and reasonable legal costs arising from your content, your breach of these terms, or your dealings with another user.
The Subby name, logo, app, website and underlying software are ours or our licensors'. These terms do not give you any right to use them beyond using the service as intended.
We may update these terms. We will change the date at the top and, where the change is material, notify you in the app or by email. Continuing to use Subby after a change takes effect means you accept the updated terms.
These terms are governed by the law of the Republic of South Africa. Please raise a dispute with us first at support@getsubby.co.za so we can try to resolve it. Failing that, the South African courts have jurisdiction.
